LIMITED WARRANTY
Summit Limited 5-year Warranty (Aluminum Climbing Treestands Only)
What is covered:
Subject to the terms, conditions and limitations outlined below, Summit aluminum climbing stands are warranted to the original purchaser for period of five years from the date of purchase against defects in materials or workmanship that adversely affect the treestand operation.
Who is covered:
This Limited Warranty applies only to the original purchaser. It is not assignable or transferable to anyone else.
How Long Coverage Lasts:
This Limited Warranty lasts for five years from the date of original purchase. Keep your sales receipt in a safe place to prove the purchase date. Without a sales receipt, the manufacturing date will be used to determine whether a treestand is still under warranty. If the manufacturing date code is removed from the treestand, the warranty is void.
What Is Not Covered:
This warranty shall not apply to any product which has not been used in accordance with instruction, damaged through use of abuse, or subjected to misuse; misapplication; neglect (including but not limited to improper maintenance); accident; improper installation; modification (including but not limited to use of unauthorized parts or attachments); adjustment or repair. The warranty does not cover any damage or issue caused by but not limited to one or more of the following: incorrect installations, abuse, alterations or modifications not performed by Summit, poor handling, misuse, accidents, improper packaging, abnormal use, lightning or weather related conditions. Warranty does not apply to any product or part thereof where the original serial number has been altered, modified, defaced or removed. Warranty does not cover damage or loss as a result of transportation of the products.

In most cases, this will be a cash register receipt. How State Law Applies:
This Limited Warranty gives you specific legal rights. You also may have other legal rights that vary from state to state. This warranty is governed by the laws of the State of Alabama, USA
Limitation of Liability
THE FOREGOING IS IN LIEU OF ALL OTHER WARRANTIES, WHETHER EXPRESS OR IMPLIED (INCLUDING THOSE OF MERCHANTABILITY AND FITNESS OF ANY PRODUCT FOR A PARTICULAR PURPOSE), AND OF ANY OTHER OBLIGATION OF LIABILITY ON THE PART OF THE COMPANY.
It is expressly understood that Summit’s liability for its products, whether due to breach of warranty, negligence, strict liability, or otherwise, is limited to the repair of the product, as stated above, and Summit will not be liable for any other injury, loss, damage, or expense, whether direct or consequential, including but not limited to loss of use, income, profit, or damage to material, arising in connection with the sale, installation, use of, inability to use, or the repair or replacement of Summit’s products. Summit reserves the right to make alterations or modifications in its products at any time, which in its opinion, may improve the performance and efficiency of the product. It shall not be obligated to make such alterations or modifications to products already in service.
Your sole and exclusive remedy pursuant to this Limited Warranty is the repair or replacement of defective parts or workmanship. In no event shall Summit, its licensors, distributors, and suppliers be liable for any direct, indirect, incidental, special, exemplary, or consequential damages, expenses, lost profits, lost savings, business interruption, lost business information, property damage, personal injuries (including death), emotional distress, pain and suffering or any other damage arising out of the use or inability to use the product, even if Summit, its licensors, distributors, or suppliers were advised of the possibility of such damages. You acknowledge that the purchase price paid for the product reflects this allocation of risk and exclusion of damages.
Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you. If the limitation of liability is not applicable, in no event shall Summit’ liability for property damage exceed the greater of $50,000 or the price paid for the product that caused such damage.
Warranty Limitations Period:
All warranties implied by law shall be limited to the lesser of the limitation periods set forth above from the date of original purchase or the limitation period applicable in the State in which the damage occurred, whichever period is shorter. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. Any action against Summit based on an alleged breach of warranty must be filed in court within 1 year of the claimed breach.
Entire Obligation:
This document states the entire obligation of Summit with respect to the product. If any part of this Limited Warranty (including the warranty disclaimers and limitations of Summit’s liability) is determined to be void, unenforceable or illegal, the invalid or unenforceable provision shall be deemed to be superseded by a valid, enforceable provision that most closely matches the intent of the original provision, and the remainder of the agreement shall remain in full force and effect.
Summit makes no other warranty beyond the terms of this Limited Warranty. No agent, employee or salesman of Summit, its licensors, distributors, or suppliers, nor any person employed by the retail dealer or seller from whom you purchased this product, is authorized to modify, extend or waive the terms of this Limited Warranty. Any statements, representations or promises made by anyone else at any time are unenforceable against Summit.
